WHAT'S THE FUSS? ISN'T MEDICAL MARIJUANA LEGAL?
In Michigan, individuals with a qualifying medical condition who are registered patients in the Michigan Medical Marihuana Program (MMMP) and have orders for medicinal marijuana from a physician can legally grow marijuana to personally treat their condition. Medical marijuana users or their licensed primary caregivers are allowed to grow up to 12 marijuana plants and possess up to 2.5 ounces of marijuana for use by the registered, qualified patients they are treating.
The South Bend Tribune reported that the state had received 7,833 applications as of mid-October 2009, but that 1,007 applications had been turned down. Those turned down are free to reapply.
YOU CAN STILL BE ARRESTED AND CHARGED IN MICHIGAN
Until your application has been received and approved, you can still be arrested and prosecuted for possession of marijuana. You could also be prosecuted if you have more than 2.5 ounces of marijuana or grow more than 12 marijuana plants. If you give marijuana to anyone else, you could be charged with distribution, a serious felony. In addition, you may be wrongly arrested and charged, even if you have been approved as a medical marijuana user.
THE GOOD NEWS ABOUT MEDICAL MARIJUANA
In October of 2009, the Obama administration issued a broad new federal policy, telling federal prosecutors it was no longer a priority to arrest people who use or possess medical marijuana in compliance with state law.
